#LetItVroom Competition Terms and Conditions (“Rules”)

1. Participation

  1. 1.1. This competition (“Competition”) is a game of skill and is conducted by Vroom Vroom Vroom Pty Ltd (“Vroom”) (www.vroomvroomvroom.com.au), a company incorporated in Australia and registered at the following address: 1143 Sandgate Road, Nundah, QLD 4012.
  1. 1.2. Entry to the Competition constitutes acceptance of these Rules and Vroom's Privacy Policy​.
  1. 1.3. The Competition is open to Eligible Entrants. An Eligible Entrant is a individual who, at the time of entry:
    1. 1.3.1. is in Australia and aged 18 years or older (13, with guardian or parent consent),
    1. 1.3.2. is not an employee of Vroom or any of its related corporations or any of their agencies associated with the Competition; and
    1. 1.3.3. is not a spouse, de-facto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.
  1. 1.4. Competition entry opens on 12 December 2018 and closes at 5pm on 31 January 2019 (Entry Period).
  1. 1.5. All times and dates specified in these Rules are times and dates in Brisbane, Australia.

2. Entry

  1. 2.1. To enter, an Eligible Entrant must complete each of the following tasks during the Entry Period:
    1. 2.1.1. book a rental car through Vroom for pick up within Australia with a pick up date during the period 12 December 2018 - 31 January 2019 and a drop off date which is on or before 8 February 2019 (Vroom Rental Trip),
    1. 2.1.2. post an interesting photo or video, which includes the Vroom Rental Trip vehicle in the image (“Content”), on both of, or either, the Instagram and Twitter platforms, and for that post:
      1. 2.1.2.1.1. use #letitvroom hashtag
      2. 2.1.2.1.2. tag @vroomcarrentals and
      3. 2.1.2.1.3. tag one friend in the post who you would like to share your Vroom Rental Trip memory with, and
    1. 2.1.3. follow @vroomcarrental on the platforms where the content was shared.
  1. 2.2. Eligible Entrants may enter the Competition as many times as they like by posting different Content for each entry; duplicate or near duplicate Content will result in disqualification from the Competition.
  1. 2.3. Anyone found to use multiple accounts to enter the Competition will be disqualified.
  1. 2.4. Content must be an entrants' original work and must not have been published previously or used to win prizes in other competitions.
  1. 2.5. Vroom reserves the right, at any time, to request verification of the age, identity, residential address or any other information relevant to participation in the Competition of all entrants.
  1. 2.6. Vroom reserves the right to disqualify any entrant who provides false information or fails to provide information that is reasonably requested by the Promoter.
  1. 2.7. Vroom reserves the right, in its sole discretion, to refuse to accept and to remove from Vroom's galleries, accounts or landing pages, and report to, Instagram or Twitter, entries which are incomplete, indecipherable, offensive, defamatory false, misleading, hate speech, threatening, trolling, pornographic, incite violence, contain nudity, graphic or gratuitous violence or profanity, do not comply with these terms and conditions or which contravene any applicable laws or regulations.
  1. 2.8. Vroom reserves the right, in its sole discretion, to disqualify any entrant who has breached any of these terms and conditions, has engaged in unlawful or improper conduct or otherwise acts to cheat or undermine the fairness of the Competition by, for example, tampering with, or using or exploiting errors in, the entry process to obtain a competitive advantage over other entrants.
  1. 2.9. The eligibility of entries is solely within the discretion of Vroom.
  1. 2.10. Vroom accepts no responsibility for late, lost, misdirected or damaged entries or other communications.

3. Winner and Prize

  1. 3.1. The most creative and interesting eligible Content ​as determined by Vroom will win the Prize described in paragraph 3.2. Vroom's decision is final.
  1. 3.2. The winner will be awarded a reimbursement of up to AUD $1000 for the rental car charges paid to the Supplier for the Vroom Rental Trip (Prize).
  1. 3.3. The winner will be notified by private message through the platform used to enter​ the Content​ by no later than 5pm on 8 February 2019).
  1. 3.4. The winner will also be announced by 5pm on 8 February 2019 on Vroom's Instagram, Twitter and Facebook social media channels and in the Vroom newsletter.
  1. 3.5. To redeem the Prize, the winner must complete the tasks listed below by 5pm on 10 February 2019 (AEST):
    1. 3.5.1. notify Vroom of their email address used to make their Vroom booking and the Vroom booking confirmation number issued to them for their for the Vroom Rental Trip by direct messaging the Vroom Instagram or Twitter account, and
    1. 3.5.2. provide the details listed below by email to community@vroomvroomvroom.com.au:
    • -    a copy of their Vroom Rental Trip receipt issued by the supplier of the rental, and
    • -    bank account details.
  1. 3.6. Upon receipt of the email and required information Vroom will transfer the value, up to AUD $1000, of the supplier's rental charges for the Vroom Rental Trip, as evidenced by the receipt, to the bank account specified by the winner in the email, within 14 days.
  1. 3.7. If the winner has requested to be paid to an overseas bank account Vroom will use the exchange rate on xe.com on the day of payment.
  1. 3.8. If for any reason a winner does not redeem the Prize by 5pm on 10 February 2019 the Prize will be forfeited and will be awarded to the next best entry.
  1. 3.9. The Prize value is AUD $1000. The Prize, or any unused portion of the Prize is not transferable or exchangeable and must be taken by bank transfer.

4. Intellectual Property

  1. 4.1. Entrants warrant that their Content is not, and its use by Vroom and our related bodies corporate (Vroom Group) will not be, in breach of any person's copyright, moral rights, and rights in relation to inventions (including patents) (Intellectual Property Rights) or any other rights. Entrants agree to indemnify Vroom Group against any loss or damage suffered or incurred by the Vroom Group as a result of the entrant's breach of this clause.
  1. 4.2. By entering the Competition entrants grant to the Vroom Group a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute the Content in any and all media or distribution methods (now known or later developed). This license authorizes the Vroom Group to make entrant's Content available to the rest of the world and to let others do the same. Entrants agree that this license includes the right for the Vroom Group to provide, promote, and improve the Vroom Group and its services and to make Content available to other companies, organizations or individuals for the syndication, broadcast, distribution, promotion or publication of such Content on other media and services. Such additional uses by the Vroom Group, or other companies, organizations or individuals, may be made with no compensation paid to entrants with respect to the Content.
  1. 4.3. Entrants agree that the Vroom Group may modify or adapt their Content as it is distributed, syndicated, published, or broadcast by the Vroom Group and our partners and / or make changes to entrant's Content in order to adapt the Content to different media.

5. General

  1. 5.1. This Competition is in no way sponsored, endorsed or administered by, or associated with Instagram or Twitter.
  1. 5.2. If entry is via Instagram or if the Competition is promoted on Instagram, the Competition is in no way sponsored, endorsed, administered by or associated with Instagram and each entrant agrees to grant Instagram a complete release from any claims that they now have or may have in the future which relate to or are incidental to the Competition. Entrants acknowledge and agree that:
    1. 5.2.1. any information they provide in connection with the Competition is provided to Vroom and not to Instagram or any other social network; and
    1. 5.2.2. any questions, comments or complaints regarding the Competition will be directed to Vroom, not to Instagram or any other social network.
  1. 5.3. If entry is via Twitter or if the Competition is promoted on Twitter, the Competition is in no way sponsored, endorsed, administered by or associated with Twitter and each entrant agrees to grant Instagram a complete release from any claims that they now have or may have in the future which relate to or are incidental to the Competition. Entrants acknowledge and agree that:
    1. 5.3.1. any information they provide in connection with the Competition is provided to Vroom and not to Twitter or any other social network; and
    1. 5.3.2. any questions, comments or complaints regarding the Competition will be directed to Vroom, not to Twitter or any other social network.
  1. 5.4. To the full extent permitted by law, Vroom, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any entrant in connection with the Competition, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an entrant's rights under the Competition and Consumer Act 2010.
  1. 5.5. If any provision of these conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.
  1. 5.6. Vroom reserves the right to vary the terms of, or cancel, the Competition at any time without liability to any entrant or other person, subject to applicable laws.
