No Birds Terms & Conditions - Summary of Key Points

Rental Vehicle Excess

The Damage Excess amount is approximately AUD $1,000 and will be specified in the Rental Agreement you accept upon pick up.

The excess is the most you’ll pay towards repairs for damages to the vehicle’s bodywork, where the repairs are covered by the rental provider’s basic insurance. The basic insurance often doesn’t cover damage to other parts of the vehicle (overhead, underbody, interior, windows, wheels) or other charges (misfuelling, loss of use, key loss, towing, roadside assistance, child seats, GPS devices, personal belongings); you may be charged full costs for repair or replacement expenses that are not covered by the basic insurance.

Protection options to reduce or reimburse the rental vehicle excess are available. These options include third-party Rental Vehicle Excess insurance, and excess reduction waivers sold by the rental provider at the rental counter.

Credit Card Surcharge

No credit card fee is charged.

Security Deposit/Bond

A valid credit card in the renter's name is required upon collection of the rental vehicle. The nominated card must have available credit for the estimated rental charges plus a security deposit of AUD $500.

A valid credit card in the renter's name is required upon collection of the rental vehicle. Digital cards are not accepted. Credit cards under another person’s name are not accepted.

Cash Payments: Cash payments are not accepted.

Debit Card Payments: Debit cards are accepted.

Driver and Licence Requirements

Upon commencement of the booking, renters are required to present a valid passport or national ID card, an unrestricted driver licence printed in English, and an accepted credit or debit card.

Drivers Licence & ID

No Birds Australia recognises all current unrestricted Australian driver licences and overseas licences. Probationary licences are also accepted.

Driver licences must be printed in English with a photograph of the driver, must not be expired or suspended, and must be presented upon collection of the rental vehicle.

Should the valid driver licence be printed in a language other than English or not display a photograph of the driver, No Birds will accept a certified English translation or an International Driving Permit, which must be presented alongside the original licence.

Driver Age Requirements

All drivers must be between 21 and 79 years old upon commencement and for the duration of the rental.

Additional Drivers

Additional drivers that meet the age and licence requirements above can be added to the Rental Agreement upon collection of the rental vehicle. A charge of AUD $5 per additional driver per day will apply, capped at AUD $25 per driver.

Fuel Policy

Full to Full: The vehicle is supplied with a full tank of fuel; if the vehicle is not returned with a full tank of fuel, additional refuelling fees will apply.

Mileage

WA: Includes free unlimited mileage within 500 kilometres of Perth.

NSW/ACT: Includes free unlimited mileage within NSW/ACT.


NSW Terms and Conditions

The benefits of this agreement are in addition to and do not exclude any rights or obligations under the Competition and Consumer Act or similar State Laws

1. The Lessee agrees to:

a. Return the car to the Owner at the depot from which it was taken at the agreed time stipulated.

b. Not refuse to be tested for, nor drive with the presence of alcohol, or drugs.

c. Warrant that the lessee and any listed co-drivers are holders of a valid motor driver’s licence.

d. Accept responsibility for a breach of these conditions by the co-driver, if one is listed.

e. Not allow any other person to drive the car.

f. Drive the car only on sealed roads.

g. Not wilfully damage the car, including; not carry surfboards or any item on the roof.

h. A $300 replacement key charge, if the key is not returned with the car.

i. Return the car full of unleaded petrol - shortages are charged at $2.80 per litre.

j. Return the car in a clean condition, or a $50 cleaning fee applies.

k. Not smoke, vape, or have pets in the car, or a $200 cleaning fee applies.

l. Only have the car towed or repaired with the permission of the Owner.

m. A $25 administration fee for each traffic-infringement in addition to the fine.

n. Our Fair Use Policy. e.g. not use the car for security patrols, nor courier deliveries.

o. A $100 fee if the car is taken into Victoria, or Queensland-South-of-Bundaberg.

p. Not take the car into; South Australia, Tasmania, Northern Territory, or Queensland-North-of-Bundaberg.


2. The lessee agrees to pay for all road toll charges incurred, plus a $1 administration fee for each toll.

3. If the car is damaged, the Lessee agrees to:

a. Not leave the scene of an accident until Police attend
b. Obtain all details and assist the Owner with the recovery of damages
c. Not admit, or apportion blame
d. Complete a Police Report and the Owner's damage-report-form within 24hours
e. Provide confirmation to the Owner that the lessee and listed co-driver have a valid driver's licence
f. Pay for all damages (including theft), where the key is not returned to the Owner

4. The lessee agrees to the following apportionment and limitations of costs, authorising their Visa card or Mastercard to be debited of:

a. The charges, as agreed on the face hereof
b. A $1,000 charge for each occurrence of damage, irrespective of fault, including windscreen damage, tyre damage, lost Satnav, and lost keys.
c. All damages related to a breach of these conditions, including where details are not obtained, wilful damage and theft damages, or where keys have not been returned to the Owner.

5. If, within 30 minutes from signing, the lessee returns to the Owner to raise doubt about the car or its condition being satisfactory, the Owner will cancel this agreement and reimburse the full deposit.

6. The Owner’s business hours are:

From 7a.m to 6:30pm weekdays, from 8a.m to 3:30pm Saturdays, from 9a.m to 3:30 p.m Sundays. Closed Public Holidays. The car shall be charged for until checked in by the Owner during business hours. Each whole 24 hour period shall be charged as 1 day. One tenth of the daily charges will apply for each hour over 24 hours (e.g. 26 hours would be charged as 1.2 days).

7. The Owner may monitor the car with a tracking device.

Should the car not be returned at the agreed time, the lessee may be deemed to have stolen the car and the Owner may take steps to regain possession, including police action and nationwide circulation of personal details with photographs.

8. All transactions are processed in Australian Dollars (AUD).


WA Terms and Conditions

k. A $25 administration fee for each traffic-infringement in addition to the fine.
l. Our Fair Use Policy. e.g. not use the car for security patrols, nor courier deliveries.
m. Drive the car within 500km of Perth; Limits include: Geraldton, Paynes Find, Southern Cross, Jerramungup, Albany.
n. A $100 fee will Extend area of Use; Limits include: Exmouth, Meekatharra, Kalgoorlie, Norseman, Esperance.

2. If the car is damaged, the Lessee agrees to:

a. Not leave the scene of an accident until Police arrive.
b. Obtain all details and assist the Owner with the recovery of damages.
c. Not admit, or apportion blame.
d. Complete a Police Report.
e. Complete the Owner's damage-report-form forthwith.
f. Not have the car towed, without permission of the Owner.

3. The lessee agrees to the following apportionment and limitations of costs, authorising their Visa card or Mastercard to be debited of:

a. The charges, as agreed on the face hereof.
b. A $1,000 charge for each occurrence of damage, irrespective of fault, including windscreen damage, tyre damage, lost Satnav, and lost keys.

One tenth of the daily charges will apply for each hour over 24 hours (e.g. 26 hours would be charged as 1.2 days).

6. The Owner may monitor the car with a tracking device.

Should the car not be returned at the agreed time, the lessee may be deemed to have stolen the car and the Owner may take steps to regain possession, including police action and nationwide circulation of personal details with photographs.
